1. Definitions

- Buyer / You / Your: any natural person or legal entity purchasing Products and/or Services from us.
- Consumer: a natural person acting for purposes outside their trade, business, craft, or profession.
- Business Customer: any person or entity acting within a commercial, business, craft, or professional capacity.
- Products: all jewelry, loose stones, and related items sold by us through the Website or other sales channels.
- Services: any services we provide, including CAD Design Service, custom design work, resizing, repairs, and express production where offered.
- Custom Order: any Product that is not a standard catalog Product, any Product made to Your specifications, any Product that is clearly personalized, and any bespoke design created specifically for You. We may also expressly confirm in writing that an order is treated as a Custom Order.
- CAD Design Service: the design service consisting of creating CAD files, 3D renders, design revisions, and related design work based on Your requirements.

- Working Day: Monday to Friday, excluding public holidays in Madrid, Spain.
- Durable medium: a medium that allows You to store information for future reference for an adequate period, such as email.
- Eligible in-stock order: an order for a Product that is physically in stock, fully paid, not customized, does not require manual clarification or address correction, and has passed any payment, fraud, or verification checks reasonably required by us.

3. Scope and Applicability
- These General Terms and Conditions (“Terms”) apply to all offers, orders, and agreements between the Seller and the Buyer relating to Products and/or Services.
- These Terms apply to both Consumers and Business Customers, unless a clause explicitly states otherwise.
- If You do not agree to these Terms, You must not place an order.
- If any specific written agreement is concluded between You and Us, that agreement prevails over these Terms to the extent of any conflict.
4. Online Contracting, Order Placement, and Contract Formation
- How to place an order
- Orders may be placed via the Website, by email, or via WhatsApp.
- No minimum order quantity applies.
- Review and correction of errors
- Before submitting an order via the Website, You can review the cart and checkout details and correct input errors, including sizes, address details, and contact information.
- If You place an order via email or WhatsApp, You should review the provided summary carefully and inform us immediately of any errors.
- Order acknowledgment vs acceptance
- An automated confirmation or acknowledgment of receipt does not necessarily mean the order has been accepted.
- The contract is formed when We accept Your order and send You an order confirmation by email or another Durable medium, or when We dispatch the Products, whichever occurs earlier.
- We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment issues, legal restrictions, technical pricing errors, Product availability, or verification issues. If payment has already been received, We will refund the amount paid.
- Contract storage
- If You have an account on the Website, Your order information may be accessible through Your account area.
- You may also save or print the order confirmation email as a record of the contract.
- If You need a copy, You may request it by contacting us.
- Language
- These Terms are provided in English.
- If a translation is provided, the English version will prevail, except where mandatory Consumer protection rules require otherwise.
5. Products, Information, and Availability
- Product information
- We aim to describe Products accurately.
- Product photos, videos, renders, and screens may display colors, proportions, and metal tones differently depending on lighting and device settings.
- For Custom Orders, CAD renders and preview images are visual representations of the intended design. Minor differences may occur in the final Product, including small differences in proportions, setting details, stone appearance, or metal tone.
- Where moissanite sizes are shown in carat, these values refer to the diamond equivalent carat weight for that size unless stated otherwise.
- Availability
- All offers are subject to availability.
- If a Product becomes unavailable after You place an order, We may cancel the order and refund any amount already paid.
6. Offers, Pricing, VAT, Duties, and Import Charges
- Prices and taxes
- All prices are shown in EUR unless stated otherwise.
- The final amount payable for Your order is shown at checkout before You place the order.
- The tax treatment and any duties collected by us may depend on the destination and the information available at the time of checkout.
- Shipping costs
- We offer free worldwide shipping on every order.
- Duties and import charges
- Where duties, taxes, or similar import charges are collected by us at checkout, the checkout total is intended to be the final amount payable to us for those charges.
- If an obvious technical, carrier, customs, pricing, or integration error causes duties, taxes, shipping charges, or similar amounts to be incorrectly calculated or omitted before dispatch, We may correct the error before dispatch. In that case, We will contact You and give You the option to proceed with the corrected total or cancel the order for a full refund.
- If a customs authority, tax authority, or carrier imposes a charge outside our checkout flow and outside our reasonable control, We are not responsible for that external charge unless mandatory law requires otherwise.
- Price errors and adjustments
- We reserve the right to correct obvious pricing errors, typographical mistakes, or technical malfunctions.
- If an order has been paid and We identify an obvious pricing error before dispatch, We will contact You. You may either accept the corrected price or receive a full refund.
7. Payment
- Payment methods
- We offer a range of secure payment methods worldwide, including payment methods made available by our payment provider or providers.
- Klarna and installment options may be available in eligible countries.
- If You use a third-party payment or financing provider, that provider’s terms and conditions also apply.
- Payment timing
- For immediate payment methods, payment is due at checkout or when We send You a payment link or invoice for orders placed outside the Website.
- For deferred or installment payment methods, You must comply with the provider’s deadlines and conditions.
- Currency
- Orders are processed in EUR unless otherwise indicated.
- Any currency conversion fees or charges imposed by Your bank or payment provider are Your responsibility.
8. Custom Orders and CAD Design Service
- Requesting a Custom Order
- You may request a Custom Order via the Website, by email, or via WhatsApp.
- Custom Orders typically require Your approval of a CAD design, written specifications, or another design confirmation before production begins.
- Custom design down payment
- Custom Orders begin with a design down payment of EUR 50 to EUR 200, depending on the complexity of the project.
- This design down payment is credited toward the final quoted purchase price if You proceed with the Custom Order.
- Once We begin the CAD Design Service, the design down payment is non-refundable, except where mandatory law requires otherwise.
- Consumer request for immediate performance of the CAD Design Service
- Where legally required, by requesting and paying for the CAD Design Service, You expressly request that We begin the service immediately and acknowledge that any withdrawal rights relating to services may be reduced or lost once performance has started or been completed, in accordance with applicable law.
- Full payment and production start
- Once the full amount for a Custom Order is paid and the order is accepted by us, We may place the order into production immediately.
- Once production has started, cancellation is no longer possible and the order is no longer refundable, except where mandatory law requires otherwise or where the Product is defective or not in conformity with the contract.
- Design and production timing
- We typically create the initial 3D design within 1 to 2 Working Days.
- Each revision typically takes 1 to 2 Working Days.
- Once the design is approved, production typically takes 1 to 2 weeks.
- These timings are estimates and may vary depending on complexity, materials, workload, supplier availability, and circumstances outside our reasonable control.
- Minor variations
- The final Product may differ slightly from CAD renders, design previews, or reference images. By approving a Custom Order, You acknowledge that minor variations may occur in the finished piece.
- Refunds, exchanges, and resizing for Custom Orders
- Custom Orders are generally not eligible for refunds after delivery.
- Custom Orders remain eligible for exchange support under our voluntary exchange policy, subject to section 12.
- For custom rings, a ring size exchange is free within the applicable policy period.
- For other Custom Order changes, including changes to stone choice, design details, necklace length, bracelet length, or other specifications, additional costs may apply. We will confirm any applicable costs in writing before proceeding.
- This does not affect Your rights if the Product is defective or not in conformity with the contract.
- Express production
- On select silver Products, express production may be available for an additional fee.
- Where offered, express production reduces the usual silver production time from 2 to 3 weeks to 1 to 2 weeks.
9. Shipping, Delivery, and Dispatch
- Shipping origin and destinations
- We ship worldwide, subject to carrier availability, sanctions, customs restrictions, and legal limitations.
- Orders are shipped from Spain or from a logistics partner acting on our behalf.
- Carrier
- We use DHL Express for outbound and return shipments, subject to DHL Express service availability in the relevant country, area, or postcode.
- Dispatch and production times
- Eligible in-stock orders placed before 17:00 CET on Working Days are dispatched the same day.
- Gold and platinum Products typically require 1 to 2 weeks for production.
- Silver Products typically require 2 to 3 weeks for production.
- Custom Orders typically require 1 to 2 weeks for production after design approval.
- Loose moissanite stones not in stock typically require 1 to 2 weeks for production.
- All production times are estimates unless We expressly confirm a binding date in writing.
- Delivery times after dispatch
- Delivery within the EU is typically next business day after dispatch.
- Delivery to most major destinations worldwide is typically 2 to 3 business days after dispatch.
- Delivery times are estimates, not guaranteed delivery deadlines, and may vary for remote destinations, customs clearance, carrier disruptions, security checks, or other circumstances outside our reasonable control.
- Urgent delivery requests
- If Your deadline is tight, please contact us before ordering.
- Depending on stock, destination, timing, and carrier feasibility, We may be able to suggest in-stock alternatives, holiday destination delivery, faster options, or a temporary ring solution.
- These options are offered case by case and are not guaranteed.
10. Risk of Loss and Shipping Incidents
- Consumers
- For Consumers, the risk of loss or damage passes to You when You, or a third party indicated by You other than the carrier, acquires physical possession of the Products.
- If You arrange Your own carrier and We did not offer that carrier as an option, risk may pass when the goods are handed over to that carrier where permitted by applicable law.
- Business Customers
- For Business Customers, risk passes upon dispatch or handover to the carrier, unless otherwise agreed in writing or mandatory law provides otherwise.
- Shipping incidents
- If a parcel is lost, damaged, or materially delayed in transit, please contact us as soon as possible.
- We will investigate the issue with DHL Express and, where appropriate and in accordance with applicable law, provide a suitable remedy, which may include replacement, repair, or refund depending on the circumstances.
11. Right of Withdrawal (Consumers Only)
- Withdrawal period for eligible goods
- For eligible Products, You may withdraw from the purchase within 14 calendar days from the day You, or a third party indicated by You, receive the Products.
- If Your order is delivered in multiple parcels, the period starts when You receive the last parcel.
- How to exercise the right of withdrawal
- You may exercise withdrawal by sending us an unequivocal statement, for example by using our return form, by email, or by WhatsApp.
- You may use the model form in Annex 1, but it is not required.

- Return of Products after withdrawal
- You must return the Products to us without undue delay and in any case within 14 calendar days from the day You notified us of withdrawal.

- For eligible refund returns, return shipping is free. We will provide return instructions and, where available through DHL Express in the relevant location, arrange pickup or another return method.
- Return logistics depend on DHL Express service availability in the relevant country or area and may require reasonable cooperation from You.
- Refunds after withdrawal
- If You validly withdraw, We will refund the payments received for the withdrawn Products, including standard outbound delivery costs if any were charged.
- We will process the refund without undue delay and in any case within 14 calendar days from the day We are informed of Your withdrawal decision.
- We may withhold the refund until We have received the Products back or until You have supplied evidence of having sent them back, whichever is earlier.
- Refunds will be made using the same payment method You used, unless You expressly agree otherwise.
- Condition of returned Products
- Refund returns must be sent back in their original condition without clear signs of wear.
- You are responsible only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products, where applicable law permits this to be taken into account.
- Services, including CAD Design Service
- Withdrawal rules for Services may differ from those for goods.
- If You request that We start providing a Service during the withdrawal period, You may have to pay for the part of the Service already performed, where applicable law permits this.
- Where You expressly request immediate performance and acknowledge the legal effects, the withdrawal right for that Service may be reduced or lost once the Service has been fully performed, in accordance with applicable law.
- Exceptions to the right of withdrawal
- The right of withdrawal generally does not apply to Products made to Your specifications or clearly personalized, including many Custom Orders.
- This does not affect Your rights if the Product is defective or not in conformity with the contract.
- Other statutory exceptions may apply depending on the Product and the circumstances.
12. Returns, Exchanges, and Voluntary Policies (in addition to statutory rights)
- 90-day exchange policy
- In addition to any statutory rights, We offer a voluntary 90-day exchange policy from the date of receipt for eligible Products.
- If You or Your partner end up wanting a different size, style, or metal, You may request an exchange within this 90-day period.
- Exchange shipping is free.
- For eligible exchange requests, We will provide return instructions and, where available through DHL Express in the relevant location, arrange pickup or another return method.
- Return and reshipment logistics depend on DHL Express service availability in the relevant country or area.
- Engraved rings remain eligible for exchange under this voluntary policy.
- This voluntary exchange policy does not limit any statutory Consumer rights.
- Custom Orders under the 90-day exchange policy
- Custom Orders remain eligible for exchange support, but the scope of free exchange support is limited.
- For custom rings, a ring size exchange is free within the 90-day period.
- For other Custom Order changes, including changes to stone choice, design details, necklace length, bracelet length, or other custom specifications, additional costs may apply. We will confirm any applicable costs in writing before proceeding.
- 14-day money-back policy
- For eligible Products, You may request a refund within 14 calendar days from the day You receive the Product.
- Refund returns must be sent back in their original condition without clear signs of wear.
- Return shipping for eligible refund returns is free.
- Custom Orders are generally not eligible for refunds after delivery, unless mandatory law provides otherwise.
- This voluntary money-back policy does not limit any statutory Consumer rights.
- Cancellation before shipment
- Standard non-custom orders may be cancelled before shipment for an immediate refund.
- For Custom Orders, cancellation is no longer possible once design work has begun or production has started.
- Return and exchange procedure
- Please contact us first so We can provide the correct instructions and return method.
- We may ask for photos, measurements, and order details to speed up processing.
13. Refund Processing and Inspection
- Once the returned Product is received, We will inspect it to confirm eligibility.
- If the Product is not returned in its original condition or shows clear signs of wear, the refund may be refused or reduced where permitted by applicable law.
- This inspection process does not affect any statutory rights You may have in relation to defective or non-conforming Products.
14. Statutory Legal Guarantee and Non-Conformity (Consumers)
- Statutory rights
- If You are a Consumer, You benefit from mandatory statutory rights relating to conformity of goods under the applicable law.
- Nothing in these Terms limits or excludes those rights.
- General duration under Spanish law
- For Consumer sales governed by Spanish law and concluded from 1 January 2022, the Seller is generally liable for lack of conformity that exists at delivery and becomes apparent within three (3) years from delivery of the goods, subject to the conditions of applicable law.
- For the legally defined initial period, currently commonly referenced as two (2) years for these contracts, a lack of conformity that becomes apparent is generally presumed to have existed at delivery unless proven otherwise, subject to the applicable rules.
- How to request a remedy
- If You believe a Product is defective or not in conformity with the contract, contact us at info@mymoissanite.eu and, where possible, include photos and a description of the issue.
- Remedies
- Where applicable, remedies may include repair, replacement, price reduction, or contract termination in accordance with the law.
- Where required by law, remedies will be provided free of charge to the Consumer, including necessary shipping costs.
15. Commercial Warranty (Additional Benefit)
- Scope
- In addition to statutory legal guarantee rights, We offer a commercial warranty covering workmanship issues under normal use, such as stones falling out, loosened prongs, and comparable workmanship-related issues.
- Silver jewelry includes a 2-year commercial warranty.
- Gold and platinum jewelry include a lifetime commercial warranty.
- This commercial warranty does not affect Your statutory rights. Where mandatory law provides a longer protection period, mandatory law prevails.
- Territorial scope: this commercial warranty applies worldwide to eligible purchases made from the Seller, subject to available shipping and return logistics.
- Exclusions
- This commercial warranty does not cover normal wear and tear, superficial scratches, accidental damage, impact damage, chemical exposure, misuse, gross negligence, intentional damage, lost or stolen items, or damage caused by third-party repairs, modifications, or resizing.
- If a third-party jeweler modifies, repairs, or resizes an item without our prior written approval, the commercial warranty for the affected item or affected part is void.
- If We expressly approve a third-party jeweler in writing before the work is carried out, warranty coverage may continue to the extent confirmed by us in writing.
- Procedure
- Contact us at info@mymoissanite.eu with a description and, where possible, photos of the issue.
- Once the claim is approved, We will provide the next steps.
16. Business Customers
- Unless otherwise agreed in writing, these Terms also apply to Business Customers.
- Statutory Consumer rights, the statutory right of withdrawal, and other Consumer-specific protections in these Terms do not apply to Business Customers unless mandatory law requires otherwise.
- Any separate commercial terms agreed in writing with a Business Customer will prevail to the extent of any conflict with these Terms.
17. Product Authenticity, Materials, Packaging, and Certificates
- Materials and stones
- Unless expressly stated otherwise on the relevant product page or in a written order summary, our standard jewelry range is offered in precious metals such as 925 silver, 14K gold, 18K gold, or 950 platinum.
- Product specifications shown on the relevant product page or confirmed in writing form part of the Product description.
- Where stated on the relevant product page or confirmed in writing, standard moissanite specifications may include D colorless, VVS1, and excellent cut.
- Nickel-free, hypoallergenic, and skin sensitivity statements
- Any references to nickel-free, hypoallergenic, or sensitive-skin suitability are descriptive product statements, not medical guarantees.
- Individual skin reactions vary and cannot be fully predicted or guaranteed.
- Product-specific exceptions may apply and, where stated on the relevant product page or in writing, those product-specific statements will control.
- Packaging
- Every jewelry order includes a premium FSC-certified wooden gift box.
- Loose stones are supplied in standard protective packaging and do not include the FSC-certified wooden gift box.
- Certificates and verification
- We are developing broader certification and verification systems for our jewelry and stones.
- In the meantime, product specifications are confirmed through the relevant product listing, written order summary, and customer support documentation where applicable.
18. Liability and Limitation of Liability
- Consumers
- Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, nor does it affect statutory Consumer rights.
- General limitation where permitted
- To the extent permitted by law, our total liability for any claim relating to a Product or Service will be limited to the purchase price of the specific Product or Service giving rise to the claim.
- Delays
- We are not responsible for delays caused by circumstances outside our reasonable control, including those described in section 19.
- Where We are responsible for a delay, any mandatory remedies under applicable law remain available.
19. Force Majeure
- We are not responsible for failure or delay to fulfill any obligation due to events beyond our reasonable control, including natural disasters, strikes, lockouts, pandemics, war, civil unrest, sanctions, import or export restrictions, supplier disruption, carrier disruption, customs delays, cyber incidents, or similar events.
- In the event of force majeure, We will notify You as soon as reasonably possible. Our obligations will be suspended for the duration of the event.

- All product images, descriptions, designs, text, and Website content are our exclusive property or are used with permission and are protected by intellectual property laws.

- Our brand identifiers, including our logo and the name “My Moissanite”, are protected by applicable rights. Use without permission is prohibited.
22. Discount Codes and Vouchers
- Validity
- Discount codes or vouchers, when offered, are valid for the period stated in the relevant offer or communication.
- Restrictions
- Discount codes or vouchers may not be redeemed for cash unless required by applicable law.
- They may be non-transferable unless explicitly stated otherwise.
- We may refuse or cancel a discount code or voucher where misuse, fraud, duplication, or a technical error is reasonably suspected.

24. Governing Law and Jurisdiction
- Governing law
- These Terms and any contract between You and Us are governed by the laws of Spain.
- If You are a Consumer, this does not deprive You of the protections afforded by mandatory Consumer protection rules that apply under the law of Your habitual residence.
- Jurisdiction
- Consumers: disputes may be brought before the competent courts determined by applicable Consumer jurisdiction rules.
- Business Customers: unless mandatory law provides otherwise, the courts of Madrid, Spain will have jurisdiction.
25. Amendments, Severability, and Miscellaneous
- We may amend these Terms from time to time by publishing an updated version on the Website.
- The version applicable to Your order is the version available at the time You place the order, unless a change is required by law.
- If any provision is held invalid or unenforceable, the remainder of these Terms remains in force.
